The aim behind this new scheme is not to restrict your right to claim but rather try and improve the efficiency of the settlement process at a lower cost to all parties involved.

Should you be unfortunate enough to be involved in a road traffic accident on or after 30th April 2010 then your solicitor would complete an extensive claim notification form for you. This form would then be lodged via a website portal www.rapiclaimsettlement.co.uk

This is a web portal specifically created for use by personal injury lawyers and insurance companies. Once the claim is lodged the at fault insurance company is under pressure to acknowledge the claim within 15 working days and confirm whether liability for the accident is admitted or not.

Once liability is conceded your solicitor may then arrange for you to be examined by a doctor before submitting the medical report and any other evidence relating to any out of pocket expenses via the portal with an offer to settle the claim. The respective insurance company are again allowed only 15 working days in which to respond to the offer. Negotiation can then take place if the offer is not accepted after this time.

Once an award as to any compensation is agreed then the at fault insurance company has 10 days from acceptance in which to pay any compensation.

Therefore as you can hopefully see, the intention is to further refine and improve the procedure for settling any claim for financial losses and personal injury arising from a road traffic accident or car crash.

The above is a very brief summary of the new scheme and hopefully you'll will appreciate that there is more involved. However, the process, which has been running for 10 months now, is simpler and quicker than it was before.

Visit us at www.injuryclaimsreview.co.uk to see if we can help you with your claim for compensation

How to choose the right lawyer to make an accident compensation claim…

If you have suffered an injury in any type of accident, be it in a car or at work and it wasn’t your fault, what should you look for in a good accident claim solicitor? Read the following article to see what questions you should get an answer for before making your final decision.

Choose a compensation claims specialist

If you have been injured or hurt in an accident you must make sure to choose a compensation claim manager who is a specialist in winning these types of accident compensation. You need a compensation claim expert who specialises in injury compensation for accident victims. Do not choose a solicitor, who one day is pursuing personal injury claims, the next day a property matter and on the third day dealing with Wills. You need a specialist who does nothing but accident claims. This will improve your chances of winning your Compensation.

Choose a compensation claims manager who you actually like.

Although this might not seem important, remember that the entire accident claim can take a couple of months or even years to complete. You must be happy to talk regularly with your accident solicitors. Whereas many solicitors seem to enjoy being rude to their clients, this is no more. If you cannot find a solicitor who cannot build a relationship, change them.

Look for testimonials from previous Clients.

If you think you have found a good lawyer, the next thing to do is ask them to show the feedback from previous clients, or to display their testimonials on the website. If you cannot find at least ten of them, you really want to risk the instructions in this lawyer? Genuine feedback from others who have used the services of a lawyer should be trusted.

Will you keep all of your Compensation?

In most cases you will get to keep all of your compensation. There is no reason that you should lose the accident compensation to pay a portion of solicitor’s fees. However, make sure that you ask this question before you instruct a solicitor to help you.

Will it cost you anything to make an accident or personal injury claim?

You do not have to pay any costs or expenses, the service should be free to use if you win (no win no fee), and so again make sure you ask this when you choose your own solicitor.
For more information be sure to check our website www.injuryclaimsreview.co.uk

Driver Hit Me From Behind Can I Claim For Compensation?

During the terrible weather in December in the UK I was involved in a road traffic accident when another vehicle hit the rear of my car; this caused me to suffer a whiplash injury to my neck. The driver of the other vehicle was driving during the course of his employment. Can I still make a claim for compensation? If so how much compensation will I get and how long will it take to finish the case?
If an employee is driving whilst carrying out work for his employer and causes a road traffic accident due to his negligence, the employer will be liable for any resulting personal injury and damage to property.
Essentially, all road users have a duty of care to avoid causing injury to others who it may reasonably be anticipated may be injured by their actions or failure to act. As this duty of care has been breached and as you have suffered an injury as a result you will be able to make a claim for compensation.
Whilst it is not easy to predict how long your claim will take, the ministry of justice has introduced sweeping changes to streamline the current compensation system by speeding up the process of establishing who was at fault for the accident and finalising payment of compensation. Previously it took several months to establish liability if the insurer/compensator had to request further information.
The new process however, should see simple claims completed considerably faster. How much compensation you will receive will depend largely on how long you have suffered with your injury for. This would be determined by a medical expert who will provide his opinion on the extent of your injuries. In addition, you will also be able to claim out of pocket expenses such as lost earnings and medical expenses.

Why You Should Sue For Compensation…

Millions of people deal with personal injury situations every single year and the sad reality is that even when the injury isn't their fault a great number of men and women do not seek the compensation they are entitled to since they just don't realise that their personal injury deserves compensation.
Suffering a personal injury can have an absolutely devastating effect on your life from the moment it happens. Whether you are at work, at the shops, inside your vehicle or elsewhere, suffering a personal injury at the fault of yet another has the prospective to turn your life upside down.
All of a sudden you might be in hospital and needing numerous treatments to correct the damaged caused by the accident. Your head could be swimming with disbelief that you've got suffered a personal injury but the reality is that millions of people wake up to this exact sort of scenario daily, where their lives have been changed by an accident that was a result of no fault of your own. When such a personal injury occurs, it might not even cross your mind that you ought to be compensated. Chances are, you just desire to be told that everything is going to be okay.
Whilst in time you might recover it's the immediate knock on effects that may compound the anxiety and worry that being involved in an accident. You might begin to lose income immediately simply because you might be injured and cannot report to work. Your bills could begin to collect and turn into overdue simply because your pay has been stopped.
Who ought to be accountable for the injuries that you've sustained and more importantly, how can you go about ensuring that they pay for your personal injuries, loss of income and other problems that have directly arisen from the accident they may possibly have caused? The answer is basic: When you have been in an accident, no matter where that accident may possibly have taken location, and you turn out to be injured, you are entitled to compensation for that injury since the law decrees it so.
If there's any question as to why you must be paid for your personal injury, take into account it from the standpoint of the expenses that you are going to incur. A hospital stay may not be free of charge. Medical treatments, therapies and prescriptions will not be free. Somebody must pay for these wants when they are needed and that an individual must not be the individual who has been injured; it should be the party responsible for the injury.

Slips, Trips & Falls Compensation

A slip, trip or fall could happen anywhere and generally it may be unclear who is responsible for your injuries. If you slip on a pavement or road is it owned and maintained by the council or by a private firm or individual? If you slip on a wet patch at work are you employers liable or is it the plumber who didn't fix the pipe properly? These are all questions that you will not be asked to investigate on your own. Your solicitor will be able to advise you on the best route to finding out and your options depending on who is at fault.

What you need to do is to obtain any evidence that may be time-sensitive. E.g. if you have tripped over a broken up piece of road then try and get a photograph of it before it is repaired. If you slipped on something wet at work check that other people saw the puddle before it was cleaned up. Injuries alone do not make an entire case. If you have only just had your accident then get in contact with a solicitor as soon as possible as they will often have their own investigators who can document the evidence properly.

Unfortunately slipping and falling has been one of the most abused sections of personal injury litigation since the boom of the personal injury claims market. Everyone and his dog (literally!) started blaming all of their injuries on broken paving slabs that they saw outside their home.

At the beginning councils could not cope and simply paid out compensation to everyone as investigating and repairing might have cost them far more. In the past few years, though, the tide has turned and councils now have strict guidelines and good legislation to help them out. Even if you do trip over a broken paving slab the council might not be liable if the lip of the crack is under a certain height. Also if the slab was only broken within a specific time period such as the previous 48 hours and you tripped on it, the council could not be expected to have known. Councils are also fighting far more cases and fines for starting a frivolous lawsuit against a council can be as much as £3,000.

Those with a genuine compensation claim have need not fear and the majority claims are handled swiftly and efficiently by most councils who have hired more staff and dedicated more resources to handle accident compensation claims.

The same with slips and falls at work, you employer will be insured and the insurance companies will normally have plenty of previous data to go on relating to your claim type and the injuries you sustained. Bear in mind though, just because you've been injured does not necessarily mean that you will get compensation. If you slip on an icy driveway, if you slip in your shower, if you trip over your own shoelaces then don't expect a huge cheque in the post any time soon.

Technorati Tags: slip,trip,fall,compensation,claims,work accident,injury claim,injury compensation

Are you suffering from whiplash injuries?

Many accident victims suffer whiplash injuries, among others, when they are involved in a car accident. While most whiplash injuries heel relatively quickly and without long-term complications, it is possible to feel the effects of a whiplash injury for month-or even years- after the accident. Whiplash injuries can damage just a few structures or many, depending on the severity of the accident and direction of the injurious forces, to name a few.

For example most people think whiplash injuries only effect the neck area but they can also effect other areas such as your back and have other symptoms such as headaches. Speeds of as little as 5 mph have been documented to result in whiplash injuries. The good news is that, in most cases, whiplash injuries are treatable and reversible.

A rear-end car accident more often than not results in whiplash injuries. Head-on car accidents also cause whiplash injuries, except that in this case the whiplash process gets reversed. Side-on accidents cause whiplash injuries too. For most of the people who are victims of whiplash injuries the symptoms do not last for more than six months.

If it is that you have suffered from whiplash injuries caused by an accident that was not your fault, you will be entitled to make a compensation claim.

When you suffer whiplash injuries as a result of a car accident, you'll likely notice a few differences in your quality of life, especially at first. Initially, you will certainly notice pain as nearly all whiplash injuries bring pain to the person that has suffered this type of injury and you may notice other symptoms that can keep you from going on with your life. Unfortunately, not all people that suffer whiplash injuries recover from them completely and in fact, many suffer pain and other symptoms for the rest of their lives.

If you are involved in a road traffic accident and sustain whiplash injuries, do not be tempted to accept offers of compensation from insurance companies without legal representation. Claimants who suffer from whiplash injuries are eligible to file a whiplash injury claim if the accident that caused the injury was not their fault.

When is the right time to claim for whiplash injuries?

Since whiplash injuries can take a while to surface claimants are allowed to file a whiplash accident claim 3 years from the date of the accident. In the worst circumstances, whiplash injuries are permanent. When you talk to a medical professional about your whiplash injuries, be sure to be as detailed as possible about all the pain, discomfort, and limitations you have.

Technorati Tags: Whiplash,Compensation,Claims,Accident,Injury,Car Accident

Work Accident Compensation Claims

Not everyone realises that you could make a claim for work accident compensation but in actual fact many people can.

This article will guide you through the process of filing a work accident compensation claim so that you get maximum compensation as soon as possible.

Work accident compensation claims can be made when employees get hurt on their jobs because of the negligence of their employers.

If the incident at work has caused you to be injured or afflicted by any ailment, such as sickness, and this has affected your lifestyle in some way, it is quite feasible that you are entitled to compensation from your accidents and any monetary losses you've got incurred as a result.

Should you get treatment for your injury, and should you report your accident, perhaps even make a claim for work accident compensation?

Employees are allowed to file a work accident compensation claim if they have been injured at their work place due to the negligence of the employer. The work accident should be reported in the Accident Report book as soon as possible whist treatment for the injury should be sought straight away. The time allowed for a work accident claim must be inside three years of the accident.

It is very necessary to appreciate that when you make a work accident claim, it is a step in the correct direction for you and your employer, the work accident claim gives the employer favourable circumstances to remedy any safety concerns that may cause future losses.

One thing to note about cataloguing a work accident claim is that you are not filing against your manager directly. You should not be dismissed because of cataloguing a work accident claim. And it truly is illegal to dismiss an employee simply because they have made an accident claim, so you have no reason to b concerned about losing your employment.

You may be able to settle your work accident compensation claim outside of court, however, if you don't it may be necessary to commence with formal court proceedings. A thing to be observed is that, nearly all of the work accident claims cases are decided out of court by both the parties. If you have an accident and you find out at a later time that you sustained an injury from that accident, you can still file a work accident claim.

The work accident claim provides compensation for lost salary, physical suffering, and any later restrictions on employment due to the injuries. Work accident claims can be made for a wide range of factory accidents where the employee's injuries could have been avoided by the employer failing to take the necessary steps to make the working environment as safe as possible. If your employer has ignored this duty of care, and their negligence has caused injury, you may be able to make a work accident claim. Statistics obtained in July this year show that slips trips and falls make up 36%, the majority, of work accident claims in the UK.

How to make a work accident compensation claim?

If you have had an accident in work of any kind then you should contact a company that specialises in work accident compensation claims. Work accident compensation amounts depends on the type of claim and type of injury caused in a work place accident. Some claims companies will be specialists in work accident claims, and will be able to handle your claim on a no win no fee basis, meaning that if you are unsuccessful, you will not have to pay anything at all.

What should be kept in mind whilst claiming work accident compensation is not the fact that you are claiming against your employer but rather you are asking a compensation for something that has harmed you and it is unfair on the part of the employer for being negligent and no one else is going to pay for this but them.

Read more on this at http://www.injuryclaimsreview.co.uk/workaccidents.html

Car Accident Compensation Claims

If you are in a car accident and are not at fault, you can file a car accident compensation claim with the courts. If any of the above has happened to you, the first thing to do is to contact a specialised company who deals with personal injury compensation claims.

A good claims management company will carefully evaluate the facts of your case and inform you whether you have a good case for a car accident injury claim or not. There are usually several criteria that have to be met for structured settlements, which are relevant to your personal injury claim.

It is in your best interest to pursue your personal injury claim immediately after your accident, or at least as soon as you can once you realize you have been injured. According to the courts, you have up to three years to enter your injury claim, provided you cater the needed evidence.

If you or your loved ones are injured due to negligence or deliberate actions of some individual or authority then you can file a personal injury compensation claim.

In legal terms, an injury claim describes faultless personal injury to the body, mind, or emotions that occurred outside the individual's control. Personal injury claims allow those who have suffered damages to recoup the cost of those damages, (plus possible pain and suffering fees) deemed appropriate by evidence and a court of law.

Personal injury compensation can take the form of compensatory damages, nominal damages or punitive damages. Injury claims are very often negotiated without even having to see the light of day in court.

What are Personal Injury Claims and do you need to make one?

Have you ever wondered what personal injury compensation is?
